Surrogacy seems to be receivinggreater attention as more couples can choose this means of becoming parents.The procedure may be chosen when the biological mother is too old to carry achild or cannot conceive on her own (for example, due to a hysterectomy) or, asin the case of Elton John and his partner David Furnish, a female is requiredto produce a child for them.

Surrogacy, however, is not an easyroute to take. All surrogacy in Australia must be altruistic or non-commercial.The alternative is to purchase a surrogate, usually in the United States ofAmerica or India. For some in our society, however, the idea of surrogacy shakes the acceptedand long-held understanding of conception, birth and parenthood, even in asociety where IVF is commonly undertaken and gay couples now raise children.

Gestational surrogacy is themedical term used when the surrogate mother has no genetic link to the childshe is carrying, thereby becoming the gestational carrier. The term “birthmother” is still mostly reserved for the biological mother of a child who isthen adopted. Traditionally surrogacy was the term used when the femalecarrying the child was also the biological mother. The term “gestationalcarrier”, however, is seen by some as implying detachment and the notion thatthe surrogate is somehow stripped of her humanity and becomes the equivalent ofan incubator.

Of course that is exactly what thesurrogate mother agrees to do, notwithstanding her intimate connection with thechild over nine months. Some emotively call the process “rent a womb” but that isalso the precise nature of the contract established between the surrogatemother and those who will raise the child. Put bluntly, it is a commercialtransaction ostensibly carried out for the benefit of both parties. One mightpause, however, and consider some of the ethical and moral questions raised inthis contractual undertaking.

In the past surrogate mothers havebeen portrayed as women who have chosen to use their bodies in this manner inorder to provide financial support for their own families. Others state thatthey blossom during pregnancy and delight in bringing joy to another family,notwithstanding the fact that they are paid for the part that they play. Onewonders how they explain the pregnancy to their own children, what the effectis upon their spouse and children during the pregnancy and after yielding thechild to another couple. Does the family become attached? Does it mean thatwomen in India where the practice is growing and where it is much cheaper thanin the USA could be exploited due to poverty? If so, how can the vulnerable beprotected whilst allowing women to do with their bodies whatever they please?Is the reduction of a woman’s uterus to that of a commodity for which onereceives payment akin to that of prostitution where payment is received forsexual services provided? And if prostitution is legal, why not commercialsurrogacy? Are the future parents buying a baby or buying a gestationalcarrier? Is surrogacy providing the gift of life or demeaning women and comodifying children?

The research is very limited butreveals that surrogate mothers are carefully screened and manage to cognitivelydistance themselves from the baby throughout the pregnancy, making the child’srelease much easier. What happens, however, if she is unsuccessful indistancing herself from the child? What if the baby is deformed or disabled?Who chooses to terminate a pregnancy? What if the surrogate mother decides notto hand over the child? These are but a few of the very difficult questions tobe answered. To my knowledge no longitudinal research has been carried out onthe effect(s) of being born to a surrogate mother has on the child in question.One may hypothesise that the results may be similar to those of adoptedchildren but we have yet to be presented with good, sound evidence.

As yet we do not know whatpercentage of society accepts the notion of surrogacy, nor does there appear tobe any longitudinal research on the number of satisfactory/happy versusunsatisfactory/unhappy outcomes for the child’s parents and surrogate motheralike. Anecdotal evidence suggests that both exist. The full extent of thepsycho-social ramifications has yet to be explored. Given the public’s mixedresponse to the arrival of celebrities’ children born through surrogacy it isclear that much more work needs to be carried out in this area, one that is anethical and emotional minefield.

Thus the landscapeof issues linked with surrogacy range from legal to ethical & social.Although the socio-ethical aspects will undergo a transformation inunderstanding, interpretation & execution, it should be ensured that thelegalities laid down by the laws of the land are strictly followed. Commercial surrogacy is booming in India. It has, so far, gone unregulated – but an assisted-reproduction technologies (ART) bill is in the works. However, researchers from an NGO, the women’s health group Sama, have expressed concerns about the bill. “The many ethical issues that are emerging out of unrestrained spread of the technologies remain,” they write. The legislation aims to protect the rights of surrogate mothers, but Sama argues that it favours the rights of the commissioning couple over theirs.

The law would stipulate that only women between the ages of 21 and 35 can be surrogates. It sets a maximum number of 5 live births – an increase from 3 in the previous draft. Sama notes, however, that it does not address the number of ART cycles a woman can undergo, an important issue for women’s health.

“Most clinics provide protection to the woman in many ways, looking after her health, nutrition, daily needs, and some will even offer to take care of her family,” said Dr Ruma Satwik of the Sir Ganga Ram Hospital in Delhi. “We have all kinds of legal documents to protect the commissioning couple,” Dr Satwik said. “The surrogate mother stands to lose in the absence of concrete laws to protect her, and the provisions of the ART Bill are probably not enough.” ~

The couple, known only as Tony and Brett, revealed their unconventional family to the nation last night after bringing the babies home from India. The paper adds: "They paid $130,000 to realise their dream of having a family, with each surrogate paid $6000-$7000. The men said they would be the best parents they could be and were not fazed by judgments from others."

While Bollywood actor Aamir Khan may be candid about having taken the IVF and surrogate motherhood route following medical complications of his scriptwriter-cum-director wife Kiran Rao, there is no law in place for the general public wishing to do the same.
Even as they wait for the Assisted Reproductive Technology (Regulation) Bill, 2008, to become a law, doctors say there is great business potential for legalised surrogacy in the country.
“We have been asking the government to pass the bill, which provisions protection of rights of surrogates (like payments in instalments to ensure she is paid even in miscarriage) as well as couples (to ensure surrogate doesn’t refuse to hand over baby etc),” said Dr Aniruddha Malpani, infertility specialist.
If the law comes into force, India would become the first country to have a legal sanction on ‘paid’ surrogacy. For now, “commercial surrogacy is allowed in India under the Indian Council For Medical Research formulated ART guidelines of 2005”, said Dr Gautam Allahbadia, an IVF expert.

Dr Nandita Palshetkar, IVF specialist at Lilavati hospital said, “Aamir Khan coming out openly about IVF surrogacy will definitely help remove the taboo linked with IVF and surrogacy and spread awareness on options of having baby for couples with complicated medical history. There are so many people who are still hesitant to go for IVF or surrogacy.”
